Reputed New England mobster and FBI informant Mark Rossetti on trial for a burglary charge wont have his mob ties detailed to jurors. Superior Court Judge Jeffrey Locke noted that since Massachusetts lacks a RICO or criminal organization statute and there was no evidence in taped conversations between Rossetti and others that he was giving orders as a mob captain his mafia ties can not be detailed to the jury. Prosecutors say that Rossetti was a captain in the New England Mafia.

In October of 2010 Rossetti was charged with running a crew of 30 members who were involved in loansharking , gambling , and drug trafficking. Rossetti is also a suspect in six murders according to a law enforcement source. The FBI's handling and use of Rossetti as an informant is under investigation by a team from the Department of Justice. State Prosecutors involved in the 18 month sting that netted Rossetti's crew said the FBI was not truthful about his informant status during that period. South Boston Rep. Stephen Lynch said that Rossetti should have never qualified to be an informant according to the FBI's own guidelines. Rossetti record of violence and his long history of drug use should have disqualified him from being an informant for the feds said Lynch. Rossetti is still on the hook for charges from the October 2010 indictment past the burglary charges.
